how much does a lawyer cost in Kenya

How much does a lawyer cost in Kenya? It is one of the most searched legal questions in the country, and one of the least clearly answered. Many people delay calling an advocate because they assume the cost is unpredictable. Others accept the cheapest quote they can find and discover later that it did not cover the work they needed.

The truth is more reassuring. For many kinds of legal work, especially property transactions, Kenyan law sets out how advocates’ fees are calculated. Once you understand the framework, you can budget properly and ask the right questions before you instruct anyone. Here are seven honest answers to how much does a lawyer cost in Kenya, based on the law that governs advocates’ fees.

1. How much does a lawyer cost in Kenya? The law sets the starting point

Advocates’ fees in Kenya are governed by the Advocates Act and the Advocates (Remuneration) Order, a schedule of scale fees issued under the Act and last comprehensively revised in 2014. You can read the full Order on Kenya Law.

Paragraph 3 of the Order states that no advocate may agree to or accept remuneration at less than that provided by the Order. In other words, the scale is a floor, not a ceiling. Advocates may charge more where the work is complex or the client agrees, but they should not undercut the scale. The Law Society of Kenya also treats undercutting as a matter of professional conduct.

So when people ask how much does a lawyer cost in Kenya, the honest first answer is that, for scale work, the minimum is already written into law.

2. Buying property is charged as a percentage of value

For the sale and purchase of registered land, the Order sets a sliding scale based on the price or value. The rates apply cumulatively, band by band:

  • 2% of the first KES 5 million, with a minimum fee of KES 35,000
  • 1.5% on the portion between KES 5 million and KES 100 million
  • 1.25% on the portion between KES 100 million and KES 250 million
  • 1% on the portion between KES 250 million and KES 1 billion
  • 0.1% on the portion above KES 1 billion

On a KES 5 million purchase, the scale fee works out to KES 100,000. On a KES 10 million purchase, it is KES 175,000, being KES 100,000 on the first five million and KES 75,000 on the next five million. VAT at 16% is added where the advocate is registered for VAT.

Remember that legal fees are separate from the other costs of buying property. Stamp duty, registration fees, search fees and valuation costs are paid to government or third parties, and your advocate should give you an estimate of these alongside the fee. For a property buyer, this is the clearest answer to how much does a lawyer cost in Kenya. Our guide to the searches property lawyers in Nairobi run explains what that due diligence covers.

3. Sellers pay on the same scale, with one adjustment

The seller’s advocate is also entitled to a fee under the same scale. If the seller’s advocate does not prepare the sale agreement or letter of agreement, the Order reduces the fee by one third. If one advocate acts for both buyer and seller, which is generally best avoided because their interests differ, each side’s charges are reduced.

4. Mortgages bring a second set of legal fees

If you are buying with a mortgage, the bank will instruct its own advocate to prepare and register the charge over the property. The Order sets a separate scale for this work, and under most loan agreements, the borrower pays the lender’s legal costs. Ask your bank for an estimate early, because it can add significantly to the cash you need at completion.

5. Corporate and commercial work is often agreed in advance

Not all legal work fits a scale. Drafting a shareholders agreement, advising on a fundraise, negotiating a joint venture or running due diligence for an acquisition is usually charged by agreement, either at an hourly rate or as a fixed or capped fee. The Order expressly allows an hourly rate agreed between advocate and client for work that no other schedule covers.

For this kind of work, the answer to how much does a lawyer cost in Kenya depends on scope, complexity and urgency. The best protection is a written fee agreement under the Advocates Act, signed by the client, that sets out the scope, the basis of charging, the estimated total and what is excluded.

6. Court cases depend on value, complexity and outcome

In litigation, how much does a lawyer cost in Kenya depends largely on how far the case goes. Fees combine an instruction fee, which reflects the value and complexity of the claim, with fees for each court attendance and step in the case. Costs can rise considerably if a case is defended and goes to full trial. Kenyan law does not permit advocates to agree to be paid only if they win, so be cautious of any arrangement that looks like one.

If you win, the court may order the other side to pay some of your costs, but this rarely covers everything you paid your own advocate. Ask for an estimate for each stage of the case, not just the first step.

7. You can challenge a bill you think is wrong

Clients have real protection. An advocate must deliver a signed bill before suing for fees, and a client who disputes a bill can apply to have it taxed. Taxation is a process in which a court officer assesses each item against the Order and reduces anything that is not justified.

Before you instruct an advocate, you can also confirm that they hold a current practising certificate through the Law Society of Kenya.

Why the cheapest quote is often the most expensive

A quote far below the scale should raise questions. Either the advocate is not following the Order, or the quote leaves out work that will be billed later, or corners will be cut on due diligence. In property transactions, a missed search can cost far more than the legal fee ever would. So when you ask how much does a lawyer cost in Kenya, the better question is what the work protects.

Questions to ask about fees before you instruct a lawyer

  • Is this matter charged on the scale, by the hour or as an agreed fee?
  • What is the estimated total, including VAT?
  • What disbursements will I pay on top, and roughly how much?
  • At what stages will you bill me?
  • What work is not included in this estimate?
